Garden of Eden, 508(c)(1)(a), Private Ministerial Association Agreement with (Members) for it’s BEarth Festival

This Membership Agreement (the "Agreement") is made between the Members (the “Member”) of the Garden of Eden, a 508(c)(1)(a), Private Ministerial Association (PMA). 

The BEarth Festival is an Auxiliary Project of the Garden of Eden PMMA to foster its message and mission with its members.

By becoming a Member of Garden of Eden (PMA) the Member agrees to the following terms and conditions.

1. Membership & Engagement

The Member acknowledges that the BEarth Festival is operating as an “Auxiliary Project” of the Garden of Eden PMA, and participation in the Festival is exclusively for Garden of Eden PMA members. By signing this Agreement, the Member:

Is a Natural living human being that acts with complete coherence and own free will.

Voluntarily agrees to become a private member of the Garden of Eden PMMA and to abide by its guidelines and private agreements.

Understands that all services, access, activities, content, events, and human interactions within the Festival are conducted exclusively outside the “Unified Commercial Code” and “Commercial Law”. The Garden of Eden PMA, organizers, volunteers and anyone engaged in the Festival are not subject to state or federal public law, regulation, or oversight.

Acknowledges that this Agreement is a private contract between Garden of Eden PMA and Natural living human beings members within the PMA.

Agrees the duration of this membership is only for 8/29/25 10am to 1/9/25 10am.

2. Purpose and Mission

The Member confirms their complete alignment with the mission, teachings and values of Garden of Eden, which is to promote, improve and uplift the mental, emotional and spiritual wellbeing of our members. This agreement acknowledges the purpose of the Garden of Eden as a space for both personal and collective spiritual growth as well as envisioning a world where love, truth, freedom, and unity flourish on Earth as it is in Heaven, creating a sacred space where all can experience divine connection and spiritual fulfillment with creation. As a member of the Garden of Eden, the Member recognizes that they are part of a Private Ministerial Association exercising their rights as free men and women to gather and worship. 

The Member affirms their commitment to the mission of Garden of Eden PMA’s Auxiliary Project, BEarth Festival, which is to unite in reverence of human birth as we uplift humanity into conscious creation and embodiment. The Member acknowledges the “Festival” as a living prayer for the future generations with the purpose of taking a three day passage through the birth continuum filled with workshops, presentations, healing sessions, farm to table food, and community connection. 

3. The Land

The Garden of Eden PMA grants the Member the permission and ability to enter the property and utilize the assigned areas, facilities and structures, within the regulations of the Festival, for the duration of the Festival. The Members acknowledge they are on sacred land, at a sacred site at the base of the Kalalea mountain range. The land is to be respected and honored at all times. The Member agrees to be mindful of footprint and have minimal to zero waste on the property, to clean after themselves, and to pack and leave the land the way it was upon arrival. 

“I understand that I am responsible for my own safety, well-being and conduct during my time at the property. I agree to act in harmony with the land, beings, and spiritual values held by this sacred space. I will respect all guidelines and agreements made for the integrity of the container.”

4. Member Responsibilities to Garden of Eden PMA

The Member agrees to interact with other members and others involved in the Festival in a respectful, loving, kind and honest manner. Any behavior deemed contrary to these principles may result in instant termination of membership which may result in immediate evacuation of the property and having membership denied in the future.

The Member agrees to respect the open areas, buildings and facilities by keeping the space clean, maintaining its sanctity and honoring their reservation times.

Members agree to keep within Festival’s designated area within the property and not go beyond its boundary to other buildings or areas of the property.

The Member agrees to the “No Alcohol, No Drugs & No Smoking” policy on property. 

The Member agrees to follow our strict NO pets policy on the property. 

The Member acknowledges the property and facilities are mainly solar powered and agrees to turn off all equipment and lights in the room, hallways, and restrooms before leaving the spaces.

The Member acknowledges they can have NO unauthorized open flames, weapons, or vending. 

5. Member Responsibilities to BEarth Festival 

As a condition of membership, the Member acknowledges the responsibility of respecting the following principles during the Festival:

Birth is sacred, no matter the form or method and within this Festival is free of corporate, political and religious manipulation.

Our community accepts members from diverse backgrounds, cultures, nationalities, ages and beliefs. Respect, coexistence, and appreciation of each other is imperative and expected at all times. Even though members may hold different points of views, we ask each of you to make a commitment to:
- Create a loving, safe and open environment for all Members and people involved in the Festival.
- Engage in conversation and interaction with kind words and attitude.
- Acknowledge others feelings and points of views without having to impose our own.

Respectful community culture is maintained.

Sovereignty of choice is honored.

No harming or being abusive to other Members or individuals involved in the Festival or animals, in any way, either emotionally, mentally, physically or verbally.

The body’s innate intelligence is trusted.

Elders and native wisdom are honored, with loving awareness for Hawaiian culture and Hawaiian birth traditions, and their historical challenges due to colonization and land displacement.

Children are valued as guides for a sustainable future.

Traditional practices and land stewardship are acknowledged as foundational to our community.

Each Member is fully responsible for their own behaviour, experience, reactions, and emotions.

We commit to transforming cultural conditioning that keeps us disconnected from ourselves and the Earth. 

Every individual can access their own inner wisdom. What is shared at the Festival does not seek to influence thought or option, instead it simply presents tools for each individual to follow their own guidance.

Any situation that may raise concern of personal safety, health or property has to be communicated to the Garden of Eden PMMA first and not to the state or federal authorities without Garden of Eden PMMA’s authorisation.

6. Liability and Assumption of Risk

By signing this Agreement, the Member acknowledges and agrees that:

Is voluntarily participating in the Festival as a private PMA member and assumes all responsibility for its participation, and is fully legally responsible for its own actions.

BEarth Festival, its organizers, co-producers, and affiliates are not liable for personal injury, property damage, or any unforeseen incidents during the event.

The Member releases and holds harmless both the BEarth Festival co producers and Garden of Eden from any claims, legal actions, or liabilities related to their participation.

The Member releases and holds harmless all individuals involved in the BEarth Festival and Garden of Eden from any claims, legal actions, or liabilities related to their participation.

The Member releases all liability and holds harmless the property owners where the Festival will be held and all other tenants on the property.

The Member agrees to NOT initiate any state or federal legal action against the Garden Of Eden PMA’s, BEarth Festival, property owners or any individual involved in it.

Garden of Eden PMA, the BEarth Festival and all presenters are not liable for the decisions and actions that Members may take during or after the Festival in relation to information or content shared during the Festival.

“I acknowledge that my participation in activities, events, and experiences on this land is voluntary and may involve inherent risks, including but not limited to walking on uneven terrain, engaging in movement or healing practices, interaction with animals or natural elements, and participation in group rituals or ceremonies. I assume full responsibility for any risk of injury, illness, or other harm that may arise during my time on the property.”

“I hereby release, waive, and discharge Garden of Eden PMA and BEarth Festival, its stewards, caretakers, hosts, facilitators, landholders, and affiliated ministries or councils from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or anyone for whom I am responsible, while on the premises or participating in any activity or use of the land and facilities.”

I intend by this Agreement to assume all hazards and risks, waive all rights to sue and release all liabilities and claims, and indemnify the organizers, landlords, church, hosts, facilitators or volunteers of Garden of Eden for any claims arising from my (or my minor child(ren)’s, ward(s) or minor(s) in my care) participation in the activities. I understand that this Agreement has no expiration date and remains in effect at all times that I am (or my minor child(ren)’s, ward(s) or minor(s) in my care are/is) observing or participating in the activities and will be binding on me, my family members, heirs, assigns, executors, representatives, and estate.

7. Media Release

The Attendee grants the Festival full permission to:

Record, photograph, and use images, video, or audio recordings of their participation in perpetuity.

Utilize such media for promotional, educational, and marketing purposes within all activities associated with BEarth Festival. 

8. Agreement Acknowledgment & Membership Consent

By signing this Agreement, the Member:

Affirms they have read, understood, and agreed to the terms outlined herein.

Affirms they are signing this Agreement voluntarily and without coercion.

Affirms that is representing him/her self and not another person, algorithm, institution or governamental or private agency.

Consents to becoming a bona fide Member of the Garden of Eden PMMA.

All the information and content presented during the Festival is to NOT  meant, be taken or regarded as medical advice. Neither Garden of Eden PMMA, the BEarth Festival or presenters are acting in the capacity of a licensed medical doctor, OBGWN doctor, licensed dietician-nutritionist, pelvic floor therapist, psychologist or other licensed or registered medical professional.

Activities, information or content being offered are NOT intended to treat or diagnose, and does not include treatment for or diagnosis of any illnesses, disease or disorders, whether physical, mental, psychological or emotional. You (Member) take full responsibility for your life and well-being, as well as the lives and well-being of your family and children (where applicable), and all decisions made during and after this festival.

Privacy Policy

Privacy Policy for BEarth Festival

Effective from: May 22nd 2025 to September 1st 2025.

This Privacy Policy describes how BEarth Festival, hosted by the Garden of Eden 508(c)(1)(a) Private Ministerial Association (“we,” “us,” or “our”), collects, uses, and protects your information when you engage with our festival, livestream, website, or community offerings.

By becoming a member of the Garden of Eden PMA, registering as a vendor, applying as a speaker, or engaging with any of our services, you agree to the terms outlined below.

1. Who We Are

BEarth Festival is a private, members-only event hosted under a Private Ministerial Association. This means all participants enter into a private membership relationship for spiritual, educational, and community purposes. Information collected is used within this private association and is not sold or shared publicly.

2. What Information We Collect

We may collect the following information from you:

Name, email, and contact details

Billing and payment information (processed securely via third-party services)

Membership or registration details

Media releases or appearance consents

Application materials (for vendors, volunteers, or facilitators)

Personal notes shared in private communications or ceremony contexts

Health/dietary information you choose to share (e.g., for meals or accommodations)

3. How We Use Your Information

We use this information to:

Process membership agreement and vendor applications

Send festival updates, livestream access, and communications

Create schedules and communicate logistics

Promote future BEarth Festival events, programs, or retreats (if you opt-in)

Respect any health, accessibility, or dietary accommodations you disclose

Share media content (photos/videos) of the event with consent

We only use your data within the private context of our association and never sell or rent your information.

4. Media and Livestream Notice

By attending BEarth Festival in person or online, you acknowledge and agree that:

Photos and videos may be taken during the festival.

Your likeness may appear in public-facing media used to promote the BEarth Festival.

Our livestream will capture select workshops and community spaces.

If you do not wish to be filmed or photographed, please notify us upon entry so we can accommodate you.

5. Third-Party Services

We may use third-party platforms (such as email providers, payment processors, or ticketing systems). These services are governed by their own privacy policies and are expected to handle your information securely.

6. Data Security

We take reasonable measures to protect your data from unauthorized access or misuse. Sensitive payment details are encrypted and handled securely through trusted payment platforms. Internal access to your data is restricted to only those who require it for service fulfillment.

7. Your Rights

As a member of The Garden of Eden PMA, you may request at any time:

-Access to the personal data we hold on you

-To opt out of communications or remove yourself from our private records

-That we do not use your photo or video likeness in promotional materials

8. Children’s Privacy

Our festival is a multigenerational event. We do not knowingly collect data from children under 18 without parental or guardian consent. If you believe your child’s data has been submitted in error, please contact us.

9. Policy Changes

We may update this Privacy Policy from time to time. Updates will be posted on our website and take effect immediately unless otherwise noted.

Returns & Cancellation Policy

Garden of Eden PMA reserves the right to cancel the Festival under the Force Majeure Clause as follows:

In the event of circumstances beyond Garden of Edens PMA control, including but not limited to natural disasters, severe weather, venue restrictions, public health mandates, emergencies or pandemics, Acts of God, government restrictions, war, civil unrest, or other force majeure events or any unforeseen situation that renders the in-person attendance unsafe or impossible, Garden of Eden reserves the right to cancel, postpone, modify, transition the Festival to an online-only format or reschedule the in-person attendance to a later date, whichever Garden of Eden PMA deems more appropriate and without obligation to refund memberships.

In such cases, all granted memberships will be considered null and void, and the Garden of Eden PMA’s decision on how the Festival will proceed will be communicated via the available means at the time using the contact information given in the membership form. 

In the case of the Garden of Eden deciding to hold the Festival online, the in-person Entry Passes will be converted to Livestream Access tickets, and no refunds will be issued. 

In the case of the Garden of Eden deciding to reschedule the Festival, passes will remain valid for the new date.

By purchasing a Membership, you acknowledge and agree to these terms as part of our private member agreement.
